Terms of service

Draft. The parts in [brackets] are to be completed, and the whole text is to be checked by a lawyer before the site goes live.

Last updated: [date]. These terms apply between [legal name] (“we”) and the customer (“you”) for the Octa Models service.

1. The service

We build an interactive model of a place you choose (an octagon between 1 and 30 km across) from the data sources named in the model, and host it for you for the duration of your subscription. The service is offered to businesses and professionals. [confirm: B2B only?]

2. Estimates, requests and contract

The calculator shows an indicative estimate. Pressing “Request this model” is a request, not an order: we review it and send an invoice. The contract is formed when we send the invoice [or: when you pay it]. Prices exclude VAT.

3. Modelling fee

The one-time modelling fee pays for the research and construction of the model of your place. The work is done for your place whatever the data shows, so the modelling fee is not refundable once work has started.

4. Subscription

The monthly fee covers hosting, updates and the data items you accepted, from the day each is shown to you and accepted. It is billed monthly in advance. Without a commitment it can be cancelled at the end of any month; with a 6- or 12-month commitment, at the end of the committed term. [notice period]

5. Data and its quality

Every value in a model names its source and quality grade. Where no source covers your place, the model shows no value. The data comes from third parties under their own licences (see Data sources & credits); we do not guarantee that it is complete, current or free of errors. Verification of a data point is a separate service, priced per request.

6. Your data

You keep the rights to the data you share. You grant us a non-exclusive licence to host, process and present it in your model, and to use it to improve our models (Octa Intelligence). We never sell it as raw data. You confirm you are entitled to share it; if it contains personal data of others, you tell us before sharing it.

7. Accounts, editors and viewers

Access is by email sign-in. One editor is included; more editors are charged. Viewers are free and must register. Keep access to your email account secure.

7a. Intellectual property and use of the service

[Draft written 3 Oct 2026 for the lawyer to review — not yet in force.]

Ours. The models, their methods, mathematics, calibrations and the links between them, the Octa Intelligence engine, the curated data store and its selection and arrangement, the papers, the text, the pictures and the design of this website belong to Octa HQ or its licensors and are protected by copyright, by the database right and by our trademarks Octa Models and Octa Intelligence. [Trademark registration to be confirmed.]

What you may do. As a client you may use your model, its data and its exports for your own purposes for the place you ordered, within your subscription, and share them with the editors and viewers of your place. Each export carries its sources' credits, which you keep with it.

What you may not do. Without our written permission you may not: copy, reproduce or republish the models, the papers or the mathematics shown to you; extract or re-use a substantial part of the data or of the data store; scrape, crawl or harvest the website, the models or their data by automated means; take apart, decompile or analyse the engine's code to rebuild it; or offer a service built on any of these as your own.

The mathematics shown to clients. The equations, constants and methods shown in the ∑ Math panel for the data you ordered are shown so you can check your own model. They remain ours and are licensed to you only for that purpose.

The demo. A demo is for evaluating the service. It ends at the time shown, and the same limits apply to it.

If these terms are broken we may suspend or close the account and the places it uses, and we keep all our other rights. [Remedies, governing law and jurisdiction to be set by the lawyer.]

8. Liability

[Liability clause to be written by a lawyer — typically: unlimited for intent, gross negligence and injury to life, body or health; otherwise limited to foreseeable, typical damage for breach of essential obligations.]

9. Final provisions

The law of [Germany] applies. Place of jurisdiction for merchants: [city].
